By using niveshankIQ's App, you agree to comply with and be bound by these Terms and Conditions (the 'Terms'). If you do not agree to these Terms, you must not use the App.
2. Eligibility
You must be at least 18 years old and legally authorized to trade in your jurisdiction, specifically within Nepal, to use the App. By using the App, you confirm that you meet these eligibility requirements.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately if you become aware of any unauthorized access or use of your account. We are not responsible for any losses or damages arising from your failure to secure your account credentials.
4. AI-Driven Features
Our App utilizes AI-driven features, including stock recommendations and trading signals. While we aim to provide accurate and helpful insights, you acknowledge and agree that these recommendations are not guaranteed to be accurate, complete, or reliable. You are solely responsible for any trading decisions you make based on these recommendations or trading signals. Past performance does not guarantee future results, and you should consider seeking professional advice before making any trading decisions.
5. Risks
Trading in financial markets involves significant risk of loss, and you should only trade with capital that you can afford to lose. By using the App, you acknowledge and accept the following risks:
- Market conditions can be highly volatile and may change rapidly.
- AI recommendations and trading signals may be inaccurate, outdated, or not reflect the latest market conditions. We do not guarantee their accuracy or timeliness. You agree to trade responsibly and understand the potential risks involved in using AI-driven tools for trading decisions.
6. Payments & Fees
Currently, the App is free to use. However, we reserve the right to introduce fees for using certain features or services in the future. Any such fees will be clearly communicated to you in advance, and by continuing to use the App, you consent to these future charges. Please note that all fees, once introduced, will be non-refundable.
7. Termination
We reserve the right to suspend or terminate your account at our discretion, including but not limited to violations of these Terms, fraudulent activity, or suspicious behavior. In the event of termination, your access to the App may be revoked, and you will forfeit any rights or access to the services provided by the App. We are not liable for any losses or damages incurred as a result of account suspension or termination.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with:
- Errors or inaccuracies in AI-generated recommendations or trading signals.
- System outages, disruptions, or failures, including but not limited to those caused by third-party integrations or technical issues.
- Market volatility, regulatory changes, or any external factors beyond our control.
- Any losses arising from reliance on the App's features or decisions made based on the information provided.
In no event will our total liability to you exceed the amount you have paid for access to the App, if any, during the 12-month period immediately preceding the event giving rise to the claim.
9. Privacy & Data Use
Your use of the App is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data. Please read our Privacy Policy carefully to understand how we manage your information.
10. Modifications to the Terms
We reserve the right to update or modify these Terms at any time. Any changes will be posted within the App, and you will be notified of any material changes. Continued use of the App after such modifications constitutes your acceptance of the updated Terms.
